Mandatory Benefits Under UAE Labor Law

UAE Federal Decree-Law No. 33 of 2021 mandates the following benefits for all private-sector employees:

  • Annual Leave: 30 calendar days per year after completing 1 year of service. Pro-rated at 2 days per month for partial years. Official public holidays are additional
  • End of Service Gratuity: 21 days’ basic salary per year for the first 5 years; 30 days per year thereafter. Calculated on the last basic salary. Capped at 2 years’ total salary. No gratuity if the worker resigns within the first year
  • Return Air Ticket: Employer must provide return ticket to the worker’s home country upon contract completion or termination (unless the worker resigns without completing 1 year)
  • Health Insurance: Mandatory for all employees. Employer must provide at least basic coverage. Dubai and Abu Dhabi have specific minimum coverage requirements
  • Accommodation: Employer must provide suitable accommodation meeting MOHRE standards, or an accommodation allowance
  • Sick Leave: 15 days at full pay + 30 days at half pay + 30 days unpaid, per year, with medical certificate from an approved UAE health facility. Sick leave is available after completing the probation period
  • Maternity Leave: 60 days total — 45 days at full pay + 15 days at half pay (for female workers who have completed 1 year of service)
  • Working Hours: Maximum 8 hours/day or 48 hours/week. Reduced to 6 hours/day during Ramadan for Muslim workers. Friday is the official weekly rest day (some emirates have shifted to Saturday-Sunday weekend)
  • Probation Period: Maximum 6 months. Either party can terminate with 14 days’ written notice during probation

Overtime Calculation

Overtime is calculated on the basic salary (excluding allowances). The formula:

  • Regular overtime (daytime): Basic salary ÷ 30 ÷ 8 × 1.25 per hour
  • Night overtime (10 PM – 4 AM): Basic salary ÷ 30 ÷ 8 × 1.50 per hour
  • Friday / public holiday overtime: Basic salary ÷ 30 ÷ 8 × 1.50 per hour (plus compensatory rest day, or × 2.00 if no rest day given)
  • Maximum overtime: 2 hours per day (unless specified otherwise in the employment contract)

Overtime Example

For an electrician with AED 2,000 basic salary working 2 hours of regular overtime:

  • Hourly rate: 2,000 ÷ 30 ÷ 8 = AED 8.33
  • Overtime rate: 8.33 × 1.25 = AED 10.42 per hour
  • 2 hours overtime = AED 20.83

Total Employment Cost Example

For an experienced electrician with AED 2,000 basic salary, the employer’s approximate total monthly cost:

ComponentMonthly (AED)
Basic Salary2,000
Food Allowance300
Accommodation500
Transportation200
Health Insurance80
Visa/Emirates ID (amortized over 24 months)~150
Gratuity Accrual (21 days/year ÷ 12)~117

Wages Protection System (WPS)

The UAE Central Bank’s Wages Protection System (WPS) is mandatory for all private-sector employers. All employee salaries must be transferred electronically through the WPS. Key requirements:

  • Salary must be paid within 10 days of the due date stated in the employment contract
  • Employers must register all employees with WPS through an approved bank or exchange house
  • Non-compliance results in fines and potential suspension of new work permit applications
  • Workers can verify their salary payments through the MOHRE mobile app
